SmartData UK Limited ("SmartData UK") makes information and products available on this web site, subject to the following terms and conditions. SmartData UK reserves the right to change these terms and conditions, and the products, services, prices, and programs mentioned in this site at any time, at its sole discretion, without notice. SmartData UK reserves the right to seek all remedies available by law and in equity for any violation of these terms and conditions. Any rights not expressly granted herein are reserved.

These terms and conditions help to keep "hirelog.co.uk" and "hirelog.com" a safe place to trade and set out the full extent of any agreement reached between you and SmartData UK Ltd ("SmartData") in connection with this site. You should understand that by viewing and using this site and/or placing an order, you accept the following terms and conditions: 

General

The owner of this web site is SmartData whose address is Technium, Y Lanfa, Aberystwyth, Ceredigion, SY23 1AS, UK. Registration number 4117110.

Your contract for purchases made through this web site is with SmartData.

No contract for the sale of any product license will subsist between you and SmartData until full payment has been received. An e-mail receipt will be sent to you on completion of the purchase, followed by another e-mail with your personal license code (generally within 2 working days).

You must check that the details on the e-mail receipt are correct as soon as possible and you should print out and keep a copy of it.

SmartData do not collect or see your credit or debit card details. All transactions are handled by the independent payment provider on their secure server. If you have any questions regarding the security of this information, please contact the payment provider directly.

You undertake that all details you provide to SmartData for the purpose of purchasing a software license or service are correct. That the credit or debit card you are using is your own, and that there are sufficient funds to cover the cost of the goods or services ordered.

If there are any changes to the details supplied by you it is your responsibility to inform SmartData.

Your statutory rights are not affected (in particular see below as to your rights to withdraw from the contract) but otherwise all refunds will be given at the discretion of the Company Management.

 We can accept order cancellations by email before your personal licence code is dispatched, to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it or by telephoning :       +44 (0) 845 61 280 61 during normal office hours (GMT).

If you have already received your personal license code, a refund can be made within 7 working days from the date of your payment, on condition that you uninstall the licensed software and you provide a written declaration that the software has been uninstalled and will no longer be used within 7 working days from the date of your payment. SmartData will then refund you the purchase price of the goods. Once SmartData receives notification from you that you wish to withdraw from the contract (in accordance with these terms), any sum debited to SmartData from your credit card in relation to your order will be re-credited to that credit card account as soon as possible, and in any event within 30 days of your order.     

V.A.T (Value Added Tax) 

VAT on Services (Software Licenses)

SmartData is based in the UK and part of the European Community (E.U), and as such is required to apply V.A.T. as follows:

UK businesses: V.A.T registered businesses belonging to the U.K will be charged V.A.T at 17.5%.

EU member countries outside of the UK: SmartData is NOT required under current United Kingdom laws to charge V.A.T on it's downloaded digital software (Software licenses) as long as you ("The customer") are a V.A.T registered business based in one of the E.U member countries outside of the UK and provide your VAT registration number when buying a license. You are required to account for the V.A.T. in your own country.

Consumer, charity, goverment body: SmartData software are specifically produced for business purposes and as such any individual or a Non-V.A.T registered organisation/business belonging to the U.K or other member country of the E.U will be charged V.A.T at 17.5%.

Non-EU countries: No V.A.T apply if you do not belong to the E.U.

Liability

This Liability section applies only to the extent permitted by law. For the avoidance of doubt, SmartData  do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from SmartData negligence or wilful default, or that of SmartData employees, agents or subcontractors or (b) fraudulent misrepresentation.

SmartData does not accept liability for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.

SmartData will do its best to correct errors and omissions as quickly as practicable after being notified of them.
